By order of the Supreme Court of Alabama, an attorney was disbarred from the practice of law in the State of Alabama effective March 29, 2013. The Supreme Court entered its order based upon the decision of the Disciplinary Board of the Alabama State Bar disbarring the attorney from the practice of law in the State of Alabama for violations of Rules 8.1(a), 8.1(b), 8.4(a), 8.4(c), and 8.4(g), Ala. R. Prof. C. The Board found that the attorney, who was admitted to the Alabama State Bar pursuant to Rule III, Rules Governing Admission to the Alabama State Bar, made material misrepresentations of fact during the application and admissions process. In 2013 an attorney received a private reprimand for violating Rule 1.1, Ala. R. Prof. C. In July of 2010, the attorney began serving as a volunteer lawyer to assist in drafting a Rule 32 petition for an inmate who had been convicted of capital murder. The attorney drafted and filed the petition with the Alabama Court of Criminal Appeals in 2010, and an appellate file number was assigned to the matter. The attorney was later notified by the Alabama Court of Criminal Appeals that the petition was filed in the wrong court, and should have been filed in the Circuit Court, where the inmate had been convicted. In 2011, the inmate wrote to the circuit court clerk requesting a copy of his Rule 32 petition and learned that there was no record of a Rule 32 petition being filed on his behalf.

In October of 2011, the attorney failed to pay his annual Alabama State Bar dues. As a result, on January 5, 2011, the attorney was certified as inactive for non-payment of annual dues, and remained inactive until he paid for his annual license in September of 2012. While listed as inactive for non-payment of license dues, the attorney continued to practice law.

The respondent attorney represented a client in an automobile accident case. A settlement was reached and disbursements were made by the respondent attorney in February of 2007. However, subsequent to the settlement, the respondent attorney received checks from a medical provider which represented an over-payment to the provider in excess of $4,000.00. However, the respondent attorney failed to remit those additional funds to the client.

On February 28, 2013, an attorney received a private reprimand for violating Rules 1.15(a), 1.15(b), and 5.3, Ala. R. Prof. C. The respondent attorney conducted real estate closings on five different dates for properties owned by a Credit Union. On each occasion the premiums due to a Title Company were not paid by the respondent attorney in spite of invoices sent by both the Credit Union and the Title Company. The checks made payable to Title Company were stolen by one of the respondent attorney’s former employees and the money was illegally removed from the attorney's IOLTA trust account. The respondent attorney failed to appropriately safeguard funds in her IOLTA trust account, failed to promptly deliver money owed to a third party, and failed to take reasonable efforts to ensure her employee’s conduct comported with her professional responsibilities and obligations. Additionally, the respondent attorney was ordered to attend a continuing legal education seminar on professional responsibility and/or client relations and meet with Alabama State Bar Practice Management Assistance Program.

An attorney was summarily suspended from the practice of law in the State of Alabama by order of the Disciplinary Commission of the Alabama State Bar, pursuant to Rules 8(e) and 20(a), Ala. R. Disc. P., effective February 22, 2013. The Disciplinary Commission’s order was based on a petition filed by the Office of General Counsel evidencing that the attorney failed to respond to requests for information during the course of a disciplinary investigation. On February 25, 2013, after responding to the Bar’s request for information, the attorney filed a Petition to Dissolve Summary Suspension. On February 26, 2013, the Disciplinary Commission granted the attorney’s request that the summary suspension be dissolved and entered an order to that effect.

The attorney took actions merely to harass or maliciously injure another party. The attorney also assisted or induced another individual to violate the Rules of Professional Conduct and engaged in conduct that adversely reflects on his fitness to practice law. In 2013, the Supreme Court of Alabama issued a Certificate of Judgment affirming the 2012 order of Panel III of the Disciplinary Board.

In 2006, the respondent attorney was retained to represent clients in a land dispute. The plaintiffs in the case were seeking access to cross the clients’ property against their wishes. The clients made several attempts to meet with the respondent attorney to discuss their case. However, he seldom met with them and failed to provide them any court documents. Additionally, the respondent attorney failed to provide a copy of a court order to his clients, and, as a result they were held in contempt of court. The respondent attorney also admitted he was late to a noticed deposition in September 2009. The respondent attorney’s failure to fully adequately communicate with his clients, provide important documents or make them aware of court orders, stay informed of his clients’ case, and confirm the date and time of the deposition violated Rules 1.3, 1.4(a) and 1.4(b), Ala. R. Prof. C.
